Welcome to Moye Memorial Network. These Terms of Service ("Terms") govern your access to and use of the website, digital obituary platforms, donation portals, business directories, affiliate pages, and services operated by Moye Memorial Network ("Company," "we," "us," or "our").
By accessing our platform, creating an account, posting a free or paid obituary, leaving a tribute comment, submitting a business listing, utilizing our donation tools, or interacting with our affiliate links, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
1. User Eligibility & Age Restrictions
To use our platform, post an obituary, submit a business listing, or process a payment, you must be at least 18 years of age or the legal age of majority in your jurisdiction. By using this website, you warrant that you possess the legal capacity to enter into this binding agreement.
2. Proprietary Rights & Intellectual Property
Platform Ownership: The website layout, specialized integration code, designs, automated structures, and proprietary tools were built entirely by the Company and are protected by United States and international copyright laws.
Restrictions: You may not copy, duplicate, reverse-engineer, modify, distribute, or scrape any part of our platform code, layout, visual assets, or database without explicit prior written permission from the Company.
3. Obituary Plans, Payments, & Cancellations
Service Offerings: The Company provides one (1) Free Obituary Plan and three (3) Paid Obituary Plans with enhanced features, digital real estate, or extended publication terms.
Payment Terms: All fees for our paid plans are due securely at the time of purchase via our online billing gateways. All listed prices are non-refundable once the paid obituary is published live on the network.
Active Uptime: Paid plans ensure publication of the obituary according to the specific duration outlined in your chosen plan tier. Free plans may be subject to formatting limits or structural alterations at the Company's sole discretion.
4. User-Generated Content & Interactive Tributes
Tributes and Guestbooks: Visitors to the platform may leave digital tributes, condolences, stories, and photographs ("Tributes") on individual obituary pages.
Content Ownership: Users retain ownership of the photos, text, biographical data, and Tributes they upload to the network.
License to Company: By uploading content or Tributes, you grant the Company a worldwide, perpetual, royalty-free, sublicensable license to host, display, modify, distribute, and archive that content across our network.
Newsletter & Marketing Consent: You explicitly grant the Company the right to feature publicly posted obituaries, user-submitted Tributes, and associated photographs in our quarterly newsletter (distributed every three months) and seasonal promotional materials.
Prohibited Content: You agree not to upload Tributes or content that is defamatory, fraudulent, abusive, hateful, obscene, or violates a third party's privacy, publicity, trademark, or intellectual property rights.
Removal Rights: We function strictly as an interactive computer service provider. We reserve the absolute, unilateral right to review, edit, reject, or permanently delete any obituary, comment, or user Tribute at our sole discretion without prior notice or liability.
No Duty to Screen & Copyright Disclaimer: The Company does not pre-screen, verify, or check the copyright status, ownership, or licensing permissions of any photographs, images, graphics, or text uploaded to the platform by users. You are solely and entirely responsible for ensuring you possess the legal right or license to publish any photo you submit. Moye Memorial Network disclaims all liability arising from unauthorized copyright usage, and you agree that the Company will not be held liable for any copyright infringement resulting from user-uploaded visual media.
5. Business Directory Listings & Approval Process
Directory Submissions: Related businesses (e.g., funeral homes, flower shops, monument makers) may submit their business name, descriptions, contact information, logos, and service details ("Directory Listings") to be featured in our public vendor directory.
Company Review & Approval: Submission of a Directory Listing does not guarantee publication. The Company reserves the absolute right to screen, review, vet, reject, or approve any business submission based on our internal quality standards and alignment with our community guidelines.
Accuracy of Information: Approved businesses are solely responsible for ensuring their contact details, pricing, and operating information remain accurate, lawful, and updated.
Listing Modification and Termination: The Company reserves the right to modify the layout of the directory or remove a previously approved business listing at any time, without prior notice, if the business violates these Terms or receives persistent customer complaints.
6. Digital Millennium Copyright Act (DMCA) Notice
If you believe that any content hosted on our platform infringes upon your copyright, you may submit a formal DMCA Takedown Notice to our designated agent. Your notice must include:
A physical or electronic signature of the copyright owner or authorized representative.
Identification of the copyrighted work claimed to have been infringed.
The specific URL or location of the infringing material on our site.
Your contact information (address, telephone number, and email).
A statement that you have a good faith belief that the use of the material is unauthorized.

7. Donations Page & Financial Transactions
Role of the Platform: Moye Memorial Network provides tools to allow users to collect memorial donations or fund contributions.
No Escrow or Financial Liability: We use third-party secure payment processors to route donation funds. We do not hold funds in escrow, inspect donor intentions, or mediate disputes regarding how donation funds are ultimately spent or distributed by the recipients. All donation transactions are completed at the user's sole financial risk.
8. Affiliate Links & Third-Party Vendors
Affiliate Disclosure: Our platform contains integrated affiliate links to third-party vendors (including flower shops, funeral print shops, and memorial merchandise services). We earn a commission on qualifying purchases made through these links.
Limitation of Vendor Liability: We do not own, control, or guarantee the products, physical material quality, shipping timelines, or customer service offered by these third parties. Moye Memorial Network is not responsible or liable for any transaction disputes, defective products, or delivery failures originating from external affiliate vendors.
9. Limitation of Liability & Service Disruptions
"As-Is" Service: The platform is provided strictly on an "as-is" and "as-available" basis. We do not guarantee uninterrupted server uptime, permanent data storage, or error-free operations.
Integration Failures: We are not liable for temporary data delays, automated delivery failures, or system processing glitches caused by third-party software, plugins, hosting providers, or automation tools.
Damages Cap: To the maximum extent permitted by North Carolina law, Moye Memorial Network, its owners, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the website, newsletter distributions, or interactions on the site.
10. Indemnification
You agree to indemnify, defend, and hold harmless Moye Memorial Network, its officers, directors, and employees from any claims, lawsuits, losses, liabilities, or expenses (including reasonable attorney's fees) arising out of your breach of these Terms, the accuracy or legality of the obituary listings or Tributes you submit, or your violation of any third-party rights.
11. Governing Law & Dispute Resolution
Governing Law: These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
Venue: Any formal legal actions or proceedings arising out of this platform must be filed exclusively in the courts located in Cumberland County, North Carolina.
Class Action Waiver: YOU AND THE COMPANY AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
